About the Author
Thomas J. Gardner is a proven author and widely respected practicing attorney with more than fifty years of experience, including several years as an assistant district attorney in Milwaukee, Wisconsin. Mr. Gardner received his law degree from Marquette Law School.
Terry M. Anderson is Professor of Law at Creighton University School of Law. He received his Bachelor of Arts degree in 1968 and Juris Doctor degree in 1971 from the University of North Dakota, where he was a member of the Order of the Coif and Case Editor of the North Dakota Law Review. After earning a Master of Laws degree from Harvard Law School in 1972, he joined the Creighton law faculty. He teaches Contracts, Insurance, and Secured Transactions in Personal Property.

I read the text as a required reading for a legal course in the Fraud and Forensic Science master's program at Carlow University. Prior to reading the text, the extent of my legal knowledge came from a few general business law courses taken in undergraduate school many moons ago. I found this particular text very easy to follow. The authors manage to pack in a great deal of significant information, rules, codes and laws pertinent to criminal evidence without being overbearing. The cases added throughout the chapters help put the laws into a realistic perspective; giving several examples of how the rule/law came to be and how it is used in current legal situations. Overall, the text was presented in a manageable format that would benefit a novelist or someone experienced in the legal field.

Written for the layman.

Probably the most easily understood textbook in any criminal evidence program. It is well written and packed full of relevant case law. An excellent addition to any criminal evidence text library. Plus, it is smaller in size than an average textbook. Thus, making it a little lighter and less cumbersome. Worth the price of a used copy.

Legal Elements of Fraud

I am currently a student in Carlow University's MFF program. In the most recent course, Legal Elements of Fraud, we utilized the companion text entitled Criminal Evidence Principles and Cases by Gardner and Anderson (2013). Overall, the text is replete with case examples and comprehensive information on the origins of law, the development and processes of the U.S. judicial system, and the value behind collection of evidence. Equal consideration is given to the Constitutional rights and amendments that impact all U.S. citizens, especially in their interface with the criminal justice system.
I found this to be a very appropriate text for a novice practitioner entering the field of fraud. The material is comprehensible and the authors provided a relevant summary at the end of each chapter which well encapsulated the content. I found these especially helpful in trying to analyze complex legal cases. Relative to the forensic community, the text provided a unique frame of reference for both a beginning and a seasoned fraud investigator. The legal sections were well organized and relevant rules/processes were articulated. It appears mandatory for any fraud investigator to become renounced in the legal system.
Our class assignments were well complemented by the text, in particular the subjects of evidentiary rules, hearsay exceptions, the Fourth and Fifth Amendment protections, Federal Rules of Evidence and the legal requirements for search and seizure. Of particular note were the case law examples and seminal examples of federal and state cases that set precedence for legal statutes in use today.
The delineation of a glossary, case index and subject index were equally helpful in summarizing key concepts. I opted to rent the book for this course, but upon completion of this course, I intend to purchase it. I think it will be an invaluable reference as I embark upon a career in the Fraud field.
